1. Acceptance of Terms

Welcome to SweepFeed! By accessing, browsing, or using the SweepFeed website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you ("User" or "you") and SweepFeed Inc. ("SweepFeed", "we", "us", or "our") regarding your use of the Service.

2. Description of Service

SweepFeed is an online platform that aggregates and provides users with curated information about third-party sweepstakes, contests, giveaways, and similar promotions (collectively, "Sweepstakes") found online. We use automated tools and manual curation to gather this information.

Important Clarification: SweepFeed does **not** host, sponsor, administer, or manage any of the Sweepstakes listed on the Service. We are solely an informational and organizational platform. All Sweepstakes are offered by independent third parties ("Sponsors").

Our Service may include:

  • Regularly updated listings of Sweepstakes with details such as prize descriptions, eligibility requirements, entry methods, and deadlines.
  • Tools for searching, filtering, saving, and tracking Sweepstakes entries.
  • Notification services based on user preferences.
  • Personalized recommendations (if applicable).
  • Community features (if applicable).

3. Eligibility and User Accounts

To use certain features of the Service, you may need to register for an account. By creating an account or using the Service, you represent and warrant that:

  • You are at least 18 years old or the age of majority in your jurisdiction, whichever is older. (Note: Some Sweepstakes may have different age requirements).
  • You will provide accurate, current, and complete information during registration and maintain its accuracy.
  • You will maintain the security and confidentiality of your account credentials.
  • You accept full responsibility for all activities that occur under your account.
  • You will notify us immediately of any suspected or actual unauthorized use of your account.
  • Your use of the Service does not violate any applicable laws or regulations.

You are solely responsible for ensuring you meet the eligibility requirements (e.g., age, residency) specified in the official rules of any Sweepstakes you choose to enter. SweepFeed does not verify your eligibility for specific Sweepstakes.

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated these Terms or engaged in fraudulent or illegal activity.

4. Subscription Plans and Payments

We may offer different subscription plans (e.g., Free, Basic, Premium) with varying features and limitations. Details of current plans and pricing are available on our Pricing page.

  • Billing: Paid subscriptions are billed in advance on a recurring basis (e.g., monthly or annually) as selected during checkout. Payments are processed securely through our third-party payment processor (Stripe). By providing payment information, you authorize us (through Stripe) to charge the applicable subscription fees.
  • Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account settings before the renewal date.
  • Price Changes: We reserve the right to change subscription fees. We will provide you with reasonable prior notice of any price changes. Your continued use of the Service after a price change constitutes your agreement to pay the modified amount.
  • Cancellations: You may cancel your subscription at any time via your account settings. Cancellations take effect at the end of the current billing period.
  • No Refunds: Subscription fees are non-refundable, except as required by law. No refunds or credits will be provided for partial subscription periods or unused services.

5. User Conduct and Responsibilities

You agree to use the Service responsibly and in compliance with all applicable laws and these Terms. You agree not to:

  • Use the Service for any fraudulent, illegal, or unauthorized purpose.
  • Violate the official rules of any Sweepstakes listed on the Service.
  • Misrepresent your identity or eligibility for any Sweepstakes.
  • Use automated scripts, bots, or other unauthorized means to access, scrape, or interact with the Service or to enter Sweepstakes (unless explicitly permitted by a specific feature, e.g., auto-entry for Premium users on designated contests, subject to further conditions).
  • Transmit viruses, malware, or any other malicious code.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
  • Attempt to gain unauthorized access to the Service, user accounts, or computer systems.
  • Infringe upon the intellectual property rights of SweepFeed or third parties.

Crucially, you acknowledge and agree that it is your sole responsibility to:

  • Carefully read and understand the official rules, terms, conditions, and privacy policies of each individual Sweepstakes before entering.
  • Verify the legitimacy and Sponsor of any Sweepstakes.
  • Ensure you meet all eligibility requirements for any Sweepstakes you enter.
  • Comply fully with the entry requirements and rules set forth by the Sweepstakes Sponsor.

SweepFeed is not a party to any Sweepstakes agreement between you and a Sponsor.

6. Intellectual Property Rights

The Service, including its design, text, graphics, logos, icons, images, software, and underlying code, is the property of SweepFeed Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of our Service without our express written permission.

7. User Content

If the Service allows you to submit content (e.g., comments, reviews, profile information), you retain ownership of that content. However, by submitting content, you grant SweepFeed a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such content in connection with operating, providing, and promoting the Service.

You represent and warrant that you own or have the necessary rights to submit your content and that your content does not violate these Terms or infringe upon the rights of any third party.

8. Disclaimers

Sweepstakes Information: While we strive to provide accurate and up-to-date information about Sweepstakes, we cannot guarantee the accuracy, completeness, validity, or timeliness of any information presented. Sweepstakes details, rules, and availability are determined solely by the Sponsors and are subject to change without notice. We are not responsible for errors, omissions, or outdated information regarding any Sweepstakes.

No Endorsement: Listing a Sweepstakes on our Service does not constitute an endorsement or recommendation by SweepFeed. We do not investigate the legitimacy or practices of Sweepstakes Sponsors.

Service Availability: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

No Warranty: TO THE FULLEST EXTENT PERMITTED BY LAW, SWEEPFEED INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SWEEPFEED INC., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATING TO:

  1. YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE;
  2. YOUR PARTICIPATION IN, OR INABILITY TO PARTICIPATE IN, ANY SWEEPSTAKES LISTED ON THE SERVICE;
  3. ANY ERRORS, INACCURACIES, OR OMISSIONS IN THE SWEEPSTAKES INFORMATION PROVIDED ON THE SERVICE;
  4. THE CONDUCT OR ACTIONS OF ANY SWEEPSTAKES SPONSOR OR OTHER THIRD PARTY;
  5. ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN;
  6. ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE;
  7. ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS, REGARDLESS OF THE FORM OF ACTION, IS LIMITED TO THE GREATER OF (I) THE TOTAL AMOUNT OF FEES, IF ANY, PAID BY YOU TO SWEEPFEED FOR THE SERVICE IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless SweepFeed Inc., its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.

11. Third-Party Links and Services

The Service contains links to third-party websites (including Sweepstakes Sponsor sites) and services that are not owned or controlled by SweepFeed. We have no control over, and assume no responsibility for, the content, privacy policies, terms of use, or practices of any third-party websites or services. Your interactions with such third parties are solely between you and the third party. We strongly advise you to read the terms and conditions and privacy policies of any third-party website or service that you visit.

12. Termination

We may terminate or suspend your account and/or access to the Service immediately, without prior notice or liability, for any reason or no reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings or by contacting us.

Provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect (e.g., via email or a notice within the Service). What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of [Insert Your State, e.g., California], United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in [Insert Your County and State, e.g., San Francisco County, California] for any actions for which we retain the right to seek injunctive or other equitable relief.

15. Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Most user concerns can be resolved quickly by contacting our support team. In the unlikely event that we are unable to resolve a complaint you may have to your satisfaction (or if we have not been able to resolve a dispute we have with you after attempting to do so informally), we each agree to resolve those disputes through binding arbitration or small claims court instead of in courts of general jurisdiction.

Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Any arbitration under these Terms will take place on an individual basis; class arbitrations and class actions are not permitted.

The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879.

16. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy (available at /privacy), constitute the entire agreement between you and SweepFeed Inc. regarding your use of the Service, superseding any prior agreements between you and us on such subject matter.
